Contractually, you are probably OK with respect to deleting the first sentence, particularly if BHS provides only object code and not source code. However, a primary purpose of both sentences is to avoid situations where the Licensee makes changes to the software or database and (a) damages a portion that BHS will have to take time and resources to diagnose and/or (b) cause the software or database to deviate from the standard product and, thereby, increase BHS' support costs. It is probably best to retain this language in some form.
