This warranty is pretty weak and, if the choice is all or nothing, General Hospital may well be in a stronger position if the warranty (and the associated disclaimers that inevitably follow) are simply deleted from the agreement. In such a case, the Uniform Commercial Code and state contract law still give the hospital the benefit of several warranties. However, in the interest of certainty of result, you still are probably better off negotiating a stronger express warranty.
