Since the standard is conformance to BHS' own documentation, there should not be too much risk in deleting the word "substantially." Indeed, the hospital should be reluctant to have somebody else determine what is, or is not, substantial in this context. However, is important to recognize the limits of this warranty (even if the word "substantial" is deleted). For example, what about all the representations and promises made by BHS in response to HCF Request for Proposals document (which was prepared at great expense to the hospital)?
