Other than minor changes to clarify the intent of the provision, there really is not much room for alternative language here, at least from BHS' perspective. Indeed, even the bold-face, capital letters are in response to the Uniform Commercial Code requirement that the exclusion of implied warranties of merchantability and fitness for a particular purpose be "conspicuous."
