BHS would be very reluctant to accept any liability at all for these types of damages. However, if the transaction is sufficiently important to BHS, some small and clearly defined exception such as this may well be worthwhile to BHS. Such a modification would help the hospital recover damages that might otherwise be precluded; such as consultant's fees in implementing a replacement system.
